Generic Exemptions
Appliance Conditions Exempt when burning Appliance Type Statutory Instruments
Any fireplace (other than a fireplace fired by pulverised fuel) constructed on or after 1st July 1965 and installed before 1st September 1970 and equipped with mechanical stokers, or adapted between those dates for use with such stokers. (2)    No fuel shall be used other than that for which the mechanical stoker was designed.  Generic Exemption  NISR 2012 No.379
 
Any fireplace (other than a fireplace fired by pulverised fuel) constructed on or after 31st December 1956 (Northern Ireland 1st July 1965) and installed before 28th April 1982 (Northern Ireland 1st September 1970) and equipped with mechanical stokers, or adapted between those dates for use with such stokers. (2)    The fuel for which the mechanical stoker was designed.  Generic Exemption  NISR 2012 No.379
 
Any fireplace designed to burn coal (other than a fireplace fired by pulverised coal) with a heating capacity exceeding 150,000 British thermal units per hour (Northern Ireland 160MJ) constructed and installed on or after 31st December 1956 (Northern Ireland 1st july 1965) and equipped with mechanical stokers or adapted on or after that date for use with such stokers.    The fuel for which the mechanical stoker was designed.  Generic Exemption  NISR 2012 No.379
 
Any fireplace designed to burn coal (other than a fireplace fired by pulverised coal) with a heating capacity exceeding 160 megajoules per hour constructed and installed on or after 1st July 1965 and equipped with mechanical stokers or adapted on or after that date for use with such stokers.    No fuel shall be used other than that for which the mechanical stoker was designed.  Generic Exemption  NISR 2012 No.379

Guidance on WID can be obtained by contacting Defra, the Department of Environment Northern Ireland (DoE NI), Welsh Assembly Government (WAG) or Scottish Government. It is the responsibility of the appliance operator to ensure compliance with all relevant legislation.
  3. This appliance was recommended for exemption but was not included in a Statutory Instrument (SI) in error. The appliance is therefore not legally exempt but has been assessed as meeting the requirements for exemption and is expected to be exempted at the issue of the next SI.
  4. As a result of devolution and subsequent legislation some appliances are no longer exempt in all regions when burning some of the fuels listed in this table as they are considered to fall within the scope of Directive 2000/76/EC on the incineration of waste (WID). The scope of each exemption should therefore be checked in the relevant legislation. It should be highlighted that if an appliance is exempt when burning material considered to fall within WID then the Clean Air Act exemption does not provide compliance with regulations introduced to implement WID as highlighted in note (2).
